Assets of the Deceased

  • A deceased person with any assets in his or her sole name, without a trust, will have an estate that must be probated. In other words the estate must go through the probate court for appointment of a personal representative to be in charge of distributing those assets. If the deceased person had a will, the assets will be distributed, per the will's direction, by the person selected by the deceased as personal representative.  If the deceased person did not have a will, the assets will be distributed per statutory guidelines.
