Why A Will

  • Who do I want to have my property?
  • Who do I want to take care of my child(ren) if something should happen to me?
  • Who do I want to oversee that my wishes are carried out?
  • If I don’t have a will what happens to my estate?

Your probate assets will be subject to distribution under the state laws of intestacy. In other words, the state has enacted laws that try to determine how a person without a will would have disposed of assets if he or she had written a will.
  • Advance Directive (Living Will)

A statement of intent usually regarding life-sustaining treatment in the event of terminal illness or permanent incapacity; it is just a directive, without appointing a person as agent to make the decision when the time comes.
